TERMS OF SERVICE

1. INTRODUCTION
Welcome to Addabbo Coach (“we”, “us”, “our”). This website and related services (the “Services”) are operated by Addabbo Coach and hosted via Shopify. By using our Services, you (“you”, “customer”) agree to these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the Services.

2. SCOPE OF SERVICES
Addabbo Coach provides digital content related to training programs, accessible immediately after purchase via an online platform (videos, documents, educational materials).
These are digital content not supplied on a tangible medium, pursuant to EU Regulation 2019/770.

3. ACCESS AND ACCOUNT
To use the Services, you may need to create an account and provide personal, payment, and other information. You agree to provide accurate, complete, and up-to-date information. You are responsible for the confidentiality of your account credentials and all activities conducted through your account.

4. SUBSCRIPTIONS AND PAYMENTS
Our digital programs are sold via subscription with automatic monthly renewal until cancelled by the customer.
Your payment method will be charged automatically at the beginning of each subscription period. Prices may change in the future, with prior notice, and you may cancel before the next renewal.

5. IMMEDIATE ACCESS AND WAIVER OF WITHDRAWAL RIGHT
By purchasing a digital program with immediate access, you expressly:

  • consent to the immediate provision of the digital content;
  • acknowledge and waive the right of withdrawal under Articles 52-59 of the Italian Consumer Code.

This is in accordance with Art. 59, letter o) of the Italian Consumer Code: once digital content is made available, the right of withdrawal does not apply.

6. "SATISFIED OR REFUNDED" GUARANTEE (7 DAYS)
Although digital content already provided is not subject to a statutory right of withdrawal, we voluntarily offer a commercial guarantee:

You may request a refund within 7 days of purchasing the first month of a subscription, provided that:

  • no more than 7 days have passed since activation;
  • the digital content has not been significantly consumed (extended access, viewing, or downloads).

This guarantee does not apply to subsequent monthly renewals (month 2, month 3, etc.). Renewals are non-refundable.

7. CANCELLATION OF SUBSCRIPTION
You may cancel your subscription at any time via order confirmation emails or your account. Cancellation stops future charges but does not refund periods already billed.

8. ORDERS AND CONTRACT FORMATION
Placing an order constitutes an offer to purchase. The contract is concluded when Addabbo Coach sends an order confirmation via email. We reserve the right to refuse or cancel orders, with any refund where applicable.

9. PRICES AND BILLING
Prices are indicated in euros and may include VAT under Italian law. You are responsible for providing a valid and updated payment method for recurring charges.

10. INTELLECTUAL PROPERTY
All digital content, text, videos, images, educational materials, trademarks, and graphics are the exclusive property of Addabbo Coach or its authorized licensors. Any unauthorized reproduction, distribution, or use is prohibited.

11. PERMITTED USE
Services may only be used for personal, non-commercial purposes. Account sharing, digital content distribution, unauthorized access, fraudulent activity, or any behavior that may harm the platform or other users is prohibited.

12. LIMITATION OF LIABILITY
To the extent permitted by Italian law, we are not responsible for:

  • temporary service interruptions;
  • technical issues beyond our control;
  • improper use of digital content;
  • indirect, consequential, or profit loss.

This is without prejudice to Articles 128-135 of the Italian Consumer Code regarding the conformity of digital content.

13. DIGITAL CONTENT CONFORMITY
Digital content must conform to the contract under EU Regulation 2019/770. In case of defects or technical problems attributable to us, the customer is entitled to repair, replacement, or proportional price reduction.

14. PRIVACY AND DATA PROTECTION
Personal data is processed in accordance with the GDPR and the Privacy Policy available here: Privacy Policy.
Shopify processes some data as a data processor.

15. CHANGES TO SERVICES OR TERMS
We may modify or update the Services or these Terms at any time. Changes will be posted on the website and, if relevant, communicated via email. Continued use of the Services constitutes acceptance of the changes.

16. GOVERNING LAW AND JURISDICTION
These Terms are governed by Italian law. For any disputes, the competent court is the consumer’s place of residence or domicile, under the Consumer Code.
